Welcome to the services provided by CNPJA TECNOLOGIA LTDA (“CNPJá” or “we”), registered under CNPJ No. 37.335.118/0001-80, owner of the CNPJá platform. Below are the Terms of Use governing the access and use of our products and services, including the web dashboard, API, Excel add-in, and online queries (collectively referred to as the “Platform” or “Services”).

Reading and understanding these Terms of Use is essential to ensure proper and secure use of our solutions. By using the Platform or purchasing any of our plans, you agree to all the terms and conditions set forth herein. If you do not agree, we recommend that you do not proceed with using our Services.

1. Purpose

1.1. Services Offered

CNPJá provides tools for querying CNPJ information, issuing proof of registration, and verifying registration status with the Brazilian Federal Revenue Service (Receita Federal) and other public agencies (such as Simples Nacional, Suframa, etc.). Additional features include geocoding, advanced company research, and other amenities.

1.2. Products

The range of products and services includes:

  • Web Dashboard for queries and report generation.
  • API for integrations (commercial and public).
  • Excel Add-in for accessing data within Microsoft Excel.
  • Online queries, available publicly with limited access or through a registered account.

1.3. Nature of the Information

CNPJá is not the original source of the data queried. The information displayed is obtained from public sources (Federal Revenue Service, State Treasury Department—Sefaz, Suframa, and others). Therefore, we are not responsible for the accuracy, timeliness, or availability of this information in the public databases.

2. Registration and Access

2.1. Eligibility

There is no age restriction for using our Services. Any individual or legal entity may create an account on the Platform.

2.2. User Account

To access advanced features, such as real-time updates or issuing proof of registration, you must create an account on our website.

  • 2.2.1. Registration Information. When registering, you are responsible for the truthfulness and completeness of all data provided.
  • 2.2.2. Responsibility for Credentials. You are responsible for keeping your login, password, and API keys confidential. Sharing these credentials with third parties (within your company or with IT service providers) is entirely your responsibility. CNPJá is not liable for unauthorized access resulting from user negligence or intentional sharing of credentials.

2.3. Free Plan

After registering, you will have access to a free plan, which offers 50 credits and a limit of up to 10 queries per minute. These credits can be used for certain specific operations, such as real-time data updates.

2.4. Public Query

It is possible to make public queries without logging in, but these are subject to a limit of 5 queries per minute per IP address and must comply with the same usage restrictions and policies described herein.

3. Subscription and Payments

3.1. Subscription Models

CNPJá offers monthly or annual subscription plans that include a certain number of credits and a per-minute query limit, according to each selected plan.

3.2. Payment Methods

Plans can be paid via:

  • Credit card (through PayPal)
  • PIX
  • Bank slip (boleto bancário)
  • Bank transfer (exclusive to annual VIP plans)

3.3. Credits and Limits

  • 3.3.1. Credit Consumption. Certain services (e.g., issuing proof of registration, real-time updates) consume credits from the user account.
  • 3.3.2. Per-Minute Limit. In addition to the credit limit, plans define how many queries can be made per minute. This limit may vary according to the chosen plan.
  • 3.3.3. Overages. If you exceed the per-minute query limit or run out of credits, the Platform may suspend or block access to the corresponding features until credits are renewed or additional credits are purchased.

3.4. Automatic Renewal

  • For credit card (PayPal) payments, the subscription renews automatically.
  • For PIX or bank slip payments, a renewal notice will be sent 10 to 14 days before the end of the current subscription period.

3.5. Cancellation

  • You may cancel at any time directly on the website.
  • After cancellation, you may use remaining credits until the end of the current billing cycle, respecting their expiration date.
  • Once the billing cycle ends, unused credits expire, and the account is reverted to the free plan.

3.6. No Refunds or Chargebacks

All transactions are considered final. There is no refund or chargeback policy if the user is dissatisfied or in the event of any temporary unavailability of the Platform.

3.7. Changes to Pricing and Conditions

CNPJá reserves the right to revise prices, credit amounts, and usage limits at any time, upon 30 (thirty) days’ prior notice to users. Continued use or subscription renewal will be considered acceptance of the new conditions.

4. Use of the API and Excel Add-in

4.1. API

We provide two APIs:

  • Public API (open to all, limited to 5 queries per minute).
  • Commercial API (requires an access key, with usage limits defined by the subscribed plan and tied to the user’s credits).

4.2. Excel Add-in

The Excel add-in is distributed via a download link and can be installed free of charge. There is no additional cost for the add-in itself, but it consumes credits and is subject to the limits of the active plan on the account.

4.3. Prohibited Uses

  • It is forbidden to use the API to recreate services, platforms, or similar products that directly compete with CNPJá.
  • It is prohibited to use the Platform for any illegal purpose or in violation of third-party rights.
  • It is prohibited to develop scripts or automations that overload the service infrastructure, as well as any other uses not explicitly authorized by CNPJá.

5. User Obligations

5.1. Compliance with Legislation

By using the Platform, the user agrees to comply with all applicable laws and regulations in Brazil, including but not limited to the LGPD (General Data Protection Law), the Consumer Protection Code (Código de Defesa do Consumidor), and other rules related to data processing, marketing, and privacy.

5.2. LGPD

Users who access and use third-party data through the Platform are fully responsible for ensuring compliance with the LGPD, particularly if the information is used for marketing, commercial prospecting, or any other purposes involving the processing of personal data.

5.3. Data Storage

The Platform does not impose restrictions on how long users may locally store data obtained via the dashboard, queries, API, or add-in. However, any further storage or processing of these data remains the user’s sole responsibility.

5.4. Access Credentials

The user is solely responsible for the use of their credentials (login, password, API keys). CNPJá will not be liable for damages resulting from improper sharing or abusive use by third parties.

5.5. Data Integrity and Accuracy

Users acknowledge that the information presented by the Platform is obtained from public sources, and the respective agencies are solely responsible for updating and maintaining these data.

6. CNPJá’s Obligations

6.1. Availability

CNPJá will make every effort to maintain high availability of its infrastructure, including databases, APIs, and the query dashboard, with a target uptime of 99%. However, we are not responsible for the availability of public agencies (Federal Revenue Service, Suframa, etc.) or for any unavailability caused by external factors (unforeseeable circumstances, force majeure, cyberattacks, and the like).

6.2. Information Updates

CNPJá guarantees the fidelity of the data extraction from public sources but cannot guarantee the accuracy or timeliness of these data, as we are not responsible for managing the information in those sources.

6.4. Disclaimer of Liability

  • CNPJá is not responsible for decisions or actions taken by users based on information obtained from the Platform.
  • CNPJá is not responsible for the results of any query or integration that depends on third-party services (e.g., ERP, CRM, other third-party systems).

7. Account Suspension

7.1. Violation of Terms

In the event of a violation of these Terms of Use, CNPJá may suspend or terminate the user’s account at any time, without prior notice, especially in cases of unauthorized, unlawful, or improper use that poses a risk to the security and stability of the Platform.

7.2. Loss of Credits

If the account is suspended or terminated due to a violation of these Terms, remaining credits will be forfeited, and no refund or compensation is owed to the violating user.

8. Limitation of Liability

8.1. Use of Information

CNPJá serves as a means of accessing and organizing public data and does not own the information provided by official agencies. Therefore, when making critical decisions (commercial, fiscal, legal) based on data obtained from the Platform, the user acknowledges that the final verification and the adoption of appropriate measures is the user’s sole responsibility. CNPJá cannot be held liable for the accuracy or timeliness of information originating from third parties.

8.2. Disclaimer of Liability for Unavailability

We will not be held responsible for interruptions or failures resulting from the unavailability of public services, internet connectivity issues, necessary maintenance, force majeure, or unforeseeable circumstances.

9. Changes to the Terms of Use

9.1. Updates

CNPJá may update these Terms of Use unilaterally, upon 30 (thirty) days’ prior notice to users by email, notification within the Platform, or other official communication methods.

9.2. Acceptance of Changes

Continued use of the Services after this period or upon subscription renewal will constitute acceptance of the new terms. If you do not agree with the changes, you may cancel your subscription, without prejudice to any outstanding obligations.

10. Intellectual Property

10.1. Trademark and Logo

The name “CNPJá” and its logo are registered trademarks owned by CNPJá. Their reproduction, imitation, or use without prior written authorization is prohibited.

10.2. Databases and Content

All content provided on the Platform, including but not limited to text, images, code, layout, and databases, is the exclusive property of CNPJá or third parties who have granted us a license. Any reproduction or distribution without express authorization is forbidden.

11. General Provisions

11.1. Force Majeure

CNPJá will not be liable for any failures or delays in service provision resulting from events beyond our control, including but not limited to the unavailability of public agencies’ servers.

11.2. Severability

If any provision of these Terms is deemed illegal, void, or unenforceable, the remaining provisions shall remain in full force and effect.
